General terms and conditions

1. Test items

Airbags, inflators, pretensioners and all other pyrotechnical items used in Automotive with - or without – package can be tested. The customer delivers all necessary test items and/or original packages free of cost and within an appropriate time frame to the committed test date. After testing, all test items and package will be scraped unless otherwise expressly agreed. It’s in the nature of things, that test items and packaging will be destroyed, we exclude any liability and warranty.

2. Process

Testing will be proceeded based on the latest revision of the specifications. The requested specification has to be notified in the purchase order. Results will be compiled in a test report, in addition we provide photo and video test documentation. 

3. Requirements

The customer provides the following information/paper work prior to the tests.

‣ exact information about the test items, already existing certifications
‣ exact information about packaging, including certificates
‣ purchase order

To ease the collection of information, HPS can provide a checklist. 

4. Time line

The test date will be determined and confirmed immediately after the purchase order has been received. The released report for a test will be submitted 2 weeks after the test latest.


5. Applications

Applications will be considered on a first-come-first-served basis. The application becomes binding as soon as it is confirmed in writing by the organizer. Please make individual applications, stating the exact address, using the seminar application form on our website in writing, by e-mail or by fax to the company HPS, Fliedener Straße 40, 36119 Neuhof, Fax no. 06655/7497320. 

6. Execution of the seminar, postponement

The company HPS reserves the right to postpone or cancel seminars if the minimum number of participants is not achieved or for other reasons beyond its control. The participants shall be notified in good time. The right is reserved to make postponements or alterations in terms of seminar venues, dates, program sequence, content, lecturers, and course fees by free agreement in the event of insufficient participants and error. 

7. Cancellation and termination

The written application is binding for the participant. The participant can only cancel free of charge at the latest two weeks before the seminar begins. Cancellation must be made in writing. In the case of a cancellation received too late, or non-appearance or premature termination, the full seminar fee shall be charged. The decisive factor is the date of receipt of the cancellation by us. This also applies to self-contained modules or cycles within a complex of seminars.

8. Liability

In the case of a cancellation by the company HPS, prepaid seminar participation fees shall be reimbursed. All further claims are excluded. The company HPS is not liable for the loss or theft of personal property. The company HPS is liable for direct damages for which it is responsible regardless of the legal reasons on which the claim for damages is based only to the extent that deliberate intent or gross negligence on the part of HPS can be verified. Insofar as legally permissible, the company does not accept any liability for indirect personal injury, damage to property or financial damages or for consequential damages. Place of jurisdiction for both parties is Fulda. 

9.  Participation fee

The debtor for the fee is the party to the agreement, regardless of payments by third parties. The certification or confirmation of participation can only be handed out when the participation fee is paid. Unless stated otherwise in the seminar information, the learning and working material shall be provided by the company HPS and is included in the seminar fees.

10. Terms of payment           

The invoice is payable 14 days net upon receipt. Is the customer located in Germany, all prices plus 19 % VAT. If the customer is located outside Germany, VAT is reversed.
